20 Appearing Before and Sitting With Female Adjudicators: Reflections from Practice

Abstract
This chapter offers a reflection on the author’s experience on both sides of the bench with respect to female adjudicators. Personally, he never detected any notable differences in legal reasoning between male and female adjudicators, although research suggests that female adjudicators may make unique contributions in specific fields of international law, especially in international criminal law. Based on this experience, the chapter draws some conclusions with respect to the effect of female representation on the legitimacy of the international adjudicatory process. Despite the relative gender parity overall in the legal profession and the uniformity in legal thinking between the genders, women remain heavily underrepresented at the most senior levels of the profession, including the judicial bench. This, in turn, perpetuates the male perception of the judge. The increasing trend in the appointment of female adjudicators should therefore continue at an accelerated rate.
