This project arises out of our experiences, initially, as Legal Assistants at the Iran-US Claims Tribunal and, subsequently, as arbitration counsel, scholars, and life–long students of international dispute resolution. At the outset, it was apparent that the Iran-US Claims Tribunal's practice regarding the of Arbitral Procedure, if analyzed and accessible, would be very significant. Later, it became clear that the emerging practice of tribunals and other tribunals, primarily in the area of investor–state arbitration, would add to our understanding of the . Indeed, unlike the relatively developed and extensive systems of national procedural law, the rules of international arbitral procedure are brief (the UNCITRAL Rules only contain 41 articles). Moreover, because what little practice there is expounding on rules of arbitral procedure is often kept confidential by the parties or, in any event, is not reported upon, the extensive and potentially open practice of the Iran-US Claims Tribunal and NAFTA Chapter Eleven tribunals, in particular, is unique. With little reported practice on procedural issues, arbitrators could only learn on the job. The practice of these tribunals would remedy that deficiency.
