This article provides a critical assessment of the new retirement unfair dismissal regime, introduced by the Age Regulations1 in October 2006, to implement the UK's obligations under the age strand of the EU Framework Equal Treatment Directive.2 It argues that the new retirement regime is an unfortunate and unnecessary step on the road to dealing with the relationship between dismissal and age. It demonstrates this by placing the new retirement regime in a broader relevant public policy context, first by linking it with ongoing developments in employment law and then by looking at its relationship with state and private pension provision in the UK.
